Before submitting your application, please review Sunshine Botanicals’ Affiliate Terms & Conditions and Privacy Notice (below). By submitting your application, you acknowledge that you have read, understand, and agree to be bound by the Affiliate Terms & Conditions and Privacy Notice, and that you will honor and uphold all program guidelines upon approval.
This Affiliate Agreement (“Agreement”) is entered into and becomes effective as of the date on which the affiliate application is submitted by the applicant and accepted by Sunshine Botanicals, LLC (“Company”). This Agreement is made by and between Sunshine Botanicals, LLC (“Company”) and the individual or entity whose affiliate application has been approved (“Affiliate”).
1. PURPOSE
The purpose of this Agreement is to set forth the terms under which Affiliate will promote Sunshine Botanicals products and earn commissions on qualifying sales generated through approved tracking methods.
2. INDEPENDENT CONTRACTOR
Affiliate is an independent contractor and not an employee, partner, joint venturer, or agent of the Company. The Affiliate is responsible for all applicable taxes and expenses.
3. ENROLLMENT & ACCESS
Upon approval, Affiliate will receive a unique affiliate tracking link or code, dashboard access, and brand materials. All tracking and reporting are managed through the Company’s affiliate platform.
4. AFFILIATE RESPONSIBILITIES
Affiliate agrees to promote Sunshine Botanicals authentically, comply with FTC disclosure laws, avoid misleading or medical claims, and use only approved brand messaging.
5. COMMISSION STRUCTURE & BONUS COMPENSATION
5.1 Tiered Commission Rates
• 10% on up to $5,000 in annual tracked sales
• 12% on sales between $5,001 and $10,000
• 15% on sales exceeding $10,000
Commissions apply only to tracked net sales and exclude taxes, shipping, discounts, returns, and refunds.
5.2 Professional Opening Package Bonus
Affiliate shall earn a one-time bonus of $150 for each Professional Opening Package purchase totaling $1,500, provided the sale is tracked, completed by a qualified professional, and not refunded.
6. PAYMENTS
Commissions are paid monthly via ACH once the $50 minimum threshold is met.
7. NO GUARANTEED COMPENSATION
Affiliate acknowledges earnings are not guaranteed.
8. INTELLECTUAL PROPERTY
Affiliate receives a limited, revocable license to use Company trademarks solely for promotion.
9. CONFIDENTIALITY
Affiliate agrees to maintain confidentiality of all non-public Company information.
10. TERM & TERMINATION
This Agreement is month-to-month and may be terminated at any time by either party.
11. INDEMNIFICATION
Affiliate agrees to indemnify and hold harmless the Company from claims arising from Affiliate's actions.
12. LIMITATION OF LIABILITY
Company shall not be liable for indirect or consequential damages.
13. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Georgia
14. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement and may only be amended in writing.
15. ELECTRONIC SIGNATURE
This Agreement may be executed electronically.
IN WITNESS WHEREOF, the parties agree that this Agreement is entered into electronically and shall be deemed executed and legally binding upon the Affiliate’s electronic acceptance and the Company’s approval.

When you participate in the Sunshine Botanicals Affiliate Program through Refersion, we may collect personal information such as your name, email address, payment details, tax information, and performance data (including clicks, sales, and commissions) for the purpose of administering the affiliate program, processing payments, providing support, and improving our services.
Affiliate data is collected and managed through Refersion, a third-party affiliate tracking platform, and is used solely for program administration, tracking referrals, and issuing commission payments. Sunshine Botanicals does not sell or rent affiliate personal information to third parties. Information may be shared only with trusted service providers as necessary to operate the affiliate program, comply with legal obligations, or process payments.
By participating in the Affiliate Program, you consent to the collection, use, and processing of your information as described in this policy. Sunshine Botanicals implements reasonable safeguards to protect affiliate data; however, no method of transmission or storage is completely secure. Affiliates may request access to, correction of, or deletion of their personal information by contacting [email protected].
This Privacy Policy may be updated from time to time. Continued participation in the Affiliate Program constitutes acceptance of any changes.
